03/09/10 Kerchner v Obama & Congress, a brief filed 19 Jan 2010 with the U.S. 3rd Circuit Court of Appeals in Philadelphia PA. Perhaps worth keeping an eye on. JES http://www.scribd.com/doc/25461132/Kerchner-v-Obama-Appeal-Appellant-s-Opening-Brief-FILED-2010-01-19 . 03/04/10
I very recently turned 70 years old, and as I look around at the
country, and
the world about me, I am very pessimistic about the future. I’m ok, only a few years left in this
vale of
tears. However, people under, say 40, I
believe
face some challenges not even generally being much recognized, much
less
discussed. As
for
the United States, I no longer recognize or understand it.
The country has lost its way, never to
recover. From my perspective, there is
no way, a year after the installation of a Baraka Hussein Obama with
essentially half the population still worshiping at his feet or the
ideas he
represents, that this country can survive. That
he even should have
been seriously considered as a presidential candidate in the first
place is a
litmus test of the unfolding disaster that is accumulating. But then I would say the same thing about the
election of Billyboy Clinton in 1992. One
hundred years from now, I believe looking back, historians (if any
exist who
can think, read and write) will recognize that Clinton was the canary
in the
coal mine of that point in our history from which our mistakes of the
past will
prove to have become irredeemable. The Progressive movement has, at
least, a
300 year history. However, it’s my
belief that 1992 was the final tipping point. Others
could credibly argue for an earlier date. Our
education system has gone to hell. The
State
has subverted the family. Collectivism
and victimization have become the order of the day, with individual
freedom and
personal responsibility the new endangered species.
Any sense of objective reality, and truth, in
the singular sense, has been lost. From
a base of ego ascendant, truth has become personal, any sense of
transcendently
guided morality absent, and the State has become god. This
website has always been premised on the idea that these issues of which
I have
spoken were redeemable. A sort of denial
on my part arising from a personally ingrained constitutional worship,
if you
will, of the wisdom of our national founding. American
Exceptionalism, premised on the guidance of a
Judeo Christian
God. It is my unshakable belief that
thus it was, and it is my belief today that through Progressive
perversion,
that America is irrecoverably in its final death throws.
My Judeo Christian God has been made to be an
absolute nuisance, sometimes even within the Church itself. The problem going forward for the country,
and the world, is that He is, in fact, real, and for myself a matter
beyond
Faith. However, now I will shut up,
because no one is listening, and I truly fear His judgment on us all. JES 03/04/10 And yes, Senator Jim Bunning was right while his GOP colleagues hid under the bushes. It’s all over; too much damage has been done. JES .03/03/10
Going back, for a moment, to the recent Senate election in
Massachusetts, I
would remind you of what I said back on 01/19/10 regarding the election
of Republican Scott Brown: “some
sobriety on our side is
called for. Scott Brown is not a Conservative, but appears rather
out of
the old northeastern Republican mold on many issues. However, if
he is
determined to help pull the plug on ObamaCare, we will take him on a
utilitarian basis, and be grateful for the long overdue snub of the Teddy
gang “. My
point here being that his priority of accomplishing
“bipartisanship”
in his recent
vote,
by joining Democrats, to support an alleged “jobs”
bill, is totally
consistent with the dysfunctional behavior of coastal
“Republicans”. The Tea Party
crowd has no reason to be
surprised. Conservatives, cross your
fingers about Brown’s campaign “commitment” to vote
against ObamaCare, or a
watered down version of it. All these
folks are in serious need of remedial economics education.
JES 03/03/10 Texas Governor Rick Perry, in his
GOP nomination to run again for Governor, sends a clear message to
Washington
DC; “Don’t mess with Texas”. Governor
Perry; carry on. JES 02/16/10 The euro continues to slip against the dollar
in the continuing Laurel & Hardy act that has characterized the
back and
forth between these two currencies for many years.
The trajectory of both has been on a glide
path down for a long time. Until just
recently, the received wisdom among the money gods was that the dollar
was in
near free fall. However, in the nick of
time, for the moment, the euro appears
to come to the rescue of the dollar with even worse performance (think
Greece). Folks, this Alice-in-Wonderland
comedy of the
currencies cannot go on forever; both currencies are corrupt and
failing. With Obama and the Left in charge
in
Washington, and the bureaucrats in charge in Brussels, and a
Judeo-Christian
God chased out of the Commons, we are left with no hope but to grow our
own spinach;
reality is at hand. JES 02/16/10
The other day, my wife observed that were a fence post sentient, it
would
clearly understand its purpose and surroundings. For some reason,
I
reflected immediately upon Joe Biden, and by comparison, Joe does not
come off
well. Why would such an analogy come to mind? JES 02/14/10
Once again, former Vice President Dick Cheney goes on the attack;
last
man standing, to lay it on straight and the most qualified to do so.
Some
ask why he does it. It's because he is a patriot and the most
knowledgeable
man alive on issues of American national security at this time,
willing,
and in
a position, to say what has to be said. However a man like Cheney is
more than
willing. He knows the truth and the difference between right and wrong,
and he gushes with love for his country and the sense of responsibility
that
goes with a man in his position of insight and knowledge.
Straightforward,
tough and not about to stand by and watch his country or himself
overrun by a
pack of craven, lying, delusional, narcissistic psychopaths. Once
again, the
Mountain Observer salutes Dick Cheney. JES 02/13/10
A major French Bank, Societe Generale, predicts the eventual
“inevitable break-up”
of the Euro currency, and the entire “eurozone”. No surprise here; the Mountain Observer wrote
on these pages some time ago about the entire farce of the European
Union,
unelected, un-republican, statist and fascist in design, and counter to
the
fundamentals of basic conservative analysis.
The bureaucrats have harbored impressive and tough
sounding criteria for
the membership of new nations to the east, and on the fringes, but now
there is
Greece. Greece is busted; too many decades
playing with socialism, and now the nation’s wallet is empty, and
the beggars
have turned to Brussels for a bailout. So
it turns out that Greece is the canary in the coal mine. However,
most all European countries share the flaws of cradle to grave nanny
statism
that typify the welfare state, which has been eating away at the soft
underbelly
of the entire region particularly since World War II.
The formation of the European Union was never
more than a blind band-aid on the problem, and now, finally, the
collapse in
Greece can’t be ducked. The rest of
Europe, except possibly Great Britain, is at sea with a concrete block
tied
about its leg. And this is the model to
which our own Democrats and Baraka Hussein Obama, the Magnificent,
aspire. Keep your eye on reports about the
situation
in Greece. JES 02/09/10
Today, Washington DC is buried, at near record levels, in snow. Perhaps the Lord’s way of putting the
brakes
on the government at an opportune time. Real
Americans loudly applaud. JES 02/09/10
Last week the Ford Motor company announced an annual profit
for
2009 of $2.7 billion. Great news guys;
keep it up. Of the three American
automakers, Ford was the only one with the good sense not to get in bed
with
Obama, Victim-in-Chief, and this is one result. The
Mountain Observer wishes Ford Motor well. JES 02/09/10
Rep. Michele Bachmann R-MN, don’t go away.
You have a future on the right side of
things. JES 02/05/10
Obama's "State of the Union" address was, in fact, an address
on the "State of Baraka Hussein Obama, Narcissist in Chief". Among other points, Obama, Victim-in-Chief and
Class Baiter, gives a lawyerly lecture to the Supreme Court about a
recent
decision which restored the First Amendment in its originally intended
sense. So bad that Justice Clarence
Thomas found it
advised to respond to Obama’s subtle racism with a lecture of his
own. As for you who hate corporations, I
would
point out that corporations employ thousands of people, and produce
thousands
of products and services that have fueled a free market economy as no
socialist
experiment ever could. That you rant and
rave about so much manufacturing going off shore, I would suggest you
consider
both the regulatory and tax policies that cause this to happen. However, I am off subject.
The point here is the pathetic state today of
American law schools that so massively produce such intellectual
garbage and ignorance. Now they’ve
got one occupying the highest
office in the land. JES 02/05/10
Finally Scott Brown is now the
Senator from
Massachusetts; not Conservatively perfect, but we’ll take him. Reading various Democrat explanations of this
remarkable development, the question yet again arises as to what
clinical
defect is actually present in the brains of Left-wingers. Surely
there
must be some medical explanation. To just pass it all off as
“denial” somehow
seems to fall short. No, a government
grant
to seek the answer won’t work. Do
piranhas
eat each other? I don’t know,
however
sensible people surely get my point. Lost in all of this is the ability
to think
rationally and objectively, and to recognize the singularity of Truth. JES 02/02/10
RNC Chairman Michael Steele seems to think that
voter frustration with Democrats is an automatic one for one gain for
the
GOP. He, and other Republicans like him,
just don’t get it. (The “Where
else can
they go” argument.) Well, Michael, follow the energy and the
money; which is going to the Tea Party crowd, including millions of
Conservative
registered Republicans who are fed up with a GOP elite that is
cowardly,
disingenuous and long part of the problems we all now face under a far
Leftwing
regime. Your claim, for yourself and the
Party, that you are all now sudden converts to small government
fiscally
responsible policies, for starters, is reprehensible on its face; you
have zero
credibility. Folks like me will not
“partner”
with you and your ilk; you just need to go. Be
gone. Disappear. Actual
Conservatives need to take over the
Party. Then we can say to you wishy
washy kiss ass coastal types “Where
else can they go”. Along with the
Democrats, you guys lost in Massachusetts, and the evidence of the
truth of
which I write is that it is necessary to explain this to you. You are as politically tone deaf as the
Democrat Congressional “leadership”. Go
join a sewing club. I wish you
well. Marco Rubio, we need you. JES 01/26/10

Considerations: 01/20/10 Obama’s at it again; he apparently has
signed an executive order to 01/19/10 Short one day to the year after the
coronation of Baraka Hussein Obama, the Magnificent, President of the
World,
and pretender to the role of God Himself, the lights go out. Justice prevails with election to the US
Senate of Republican
Scott Brown,
in Massachusetts, filling the seat occupied by Ted Kennedy, the
swimmer, for 46
years. How sweet it is!
Now watch Democrat officeholders, nationwide,
run for the tall grass. If this sort of
thing can happen in the People’s Republic of Taxachusetts, they
are all in deep
shxx. However,
some sobriety on our side is
called for. Scott Brown is not a
Conservative, but appears rather to be out of the old northeastern
Republican
mold on many issues. However, if he is
determined to help pull the plug on ObamaCare, we will take him on a
utilitarian basis, and be grateful for the long overdue snub of the Teddy gang.
The enormity of this development is difficult
to overstate. Meanwhile, Obama has now
taken a hit from which he will never recover, domestically or
internationally;
the economy and IslamicFascism our most serious concerns.
The Left will never get it, so the country
remains in great danger. However, I
doubt the GOP gets it either; it was the Tea Party crowd that won, and
therein
lies the fog of political war to come in America. JES 01/17/10
Link here to the 2009 Peterson Pew
Commission Report on how to work ourselves out of the national
debt, or so it
is alleged. Clearly a huge project, and
it is worthy of study by serious students of the issue. However,
the difficulty here is that this
proposal is, in an American context, politically fanciful, and largely
authored
by “experts” who are part of the original problem with
appropriate Liberal
pedigree, and without credibility. It is
useful insofar as it reveals
the detailed thinking of coastal elites still proposing
“bi-partisan”
solutions. Sorry folks, as in the opinion
of this observer we are decades beyond that; the necessary collapse of
the
dollar and national bankruptcy, slowly unfolding, is at hand. It is revealing that these folks do understand
the
seriousness of the
situation we face, however the proposed “solutions” are
either baldly Statist,
or “to be determined”. Clearly
fanciful
in the real world. As I have suggested
before: vote for Sarah, free markets, and go grow your own spinach. JES 01/16/10 Washington,
DC. What it has come to:

JES 01/10/10 Bill Clinton to Ted Kennedy: “A few years
ago, this guy [Obama] would
have been getting us coffee.” As
reported in the newly released book “Game Change”. We look forward to Bill’s reaction. JES 01/05/10 Contrary to Left Wing fantasies,
Conservatives have a practical stake in the continued physical safety
of Baraka
Hussein Obama, the Magnificent. Were
harm to come to him, or even be attempted, he would instantly be
portrayed by
his mouth pieces in the media as a martyr, or a survivor’s
equivalent. Politically, that would not be
in the
interests of Conservatives. Arguably
even worse, were the worst to happen, Joe Biden would become President. JES
. 01/02/10 Launching off into this new year, the United
States
government is a scene of fiscal disaster. All
three branches of government, over many years, own
some
responsibility, however, constitutionally, the House of Representatives
owns
the leadership of this disaster. A
founding and fundamental premise of the creation of the Federal Reserve
in 1913
was that the new Fed, a hybrid creature of private sector banking and
the
government, would at once be insulated from political interference by
Congress
so as to focus technically on the defense of, and the stability of, the
currency. Which is to say that the Feds
function
was to oversee monetary issues, as Congress was to continue oversight
of fiscal
issues. Thin constitutional ropes tied
the Fed to the government; the arrangement being an upfront admission
of
Congressional political inability to responsibly oversee Treasury
Department
operations. With the adoption of the
income tax the same year, responsible fiscal control of government
spending was
immediately a dead issue, and the unrestrained culture of thievery of
the
Treasury and political bribery was at hand. These
linked processes were not immediately apparent to
most, and took
decades to unfold and mature. Today
we
are faced with the end-of-road consequences of the nightmare. Years
ago, the Mountain Observer, in these letters, complained that the Fed,
in
recognizing Congressional fiscal irresponsibility, made hopeless
attempts to “band-aid”
the problem through the use of certain monetary initiatives; mainly
manipulation of interest rates in a way that had more to do with
imagined Keynesian
“stimulus” efforts than sticking with the Fed
responsibility of defending the currency. The
bankers should have known better;
however they knuckled under, under political pressure from which they
had theoretically
been insulated. So it is that today the
politicians are digging away at the Fed, an institution of questionable
constitutional legitimacy, originally created by Congress itself in a
self
admission of originalist constitutional irresponsibility. Early
on
upon adoption of the Constitution, was it Thomas Jefferson?, who
observed that
a Republic had been created, however, could we keep it?
This morning, the question is very much up in
the air. JES 01/01/10 I, myself, have on occasion been guilty of excusing the excesses of the ‘60s generation by recruiting the woes of their elder depression & WWII era parents. Such explanations, alone, are superficial at best. The Progressives of our day follow a lineage at least as far back as the French Revolution of the late 1700’s (in reality, it was a strung out affair). The Mountain Observer knows this, and has written here of it often, directly and in various contexts. I think it useful to make this point now as we move into an election year, frequently to be expected full of campaign rhetoric, on all sides, sometimes short of clear substance. That is the nature of political campaigns. The priority for Conservatives in 2010 will be to expose the Progressive agenda for the intellectual travesty that it is, and offer to a more receptive audience the more positive and constructive imperatives of objective reality in words and language that can connect. JES 01/01/10 I am not about to indulge in the absurdity of wishing anyone a "Happy New Year" as anyone who expects it to be, must be a cousin to an amoeba living under a rock. Western Civilization crash landed in 2009 following a 220 year glide path into hell. So, Conservatives, we start from there. We are Americans, so let’s get to work. JES .
